In a 5-4 vote, the United States Supreme Court has ruled that the Trump Administration is acting within its authority to deport members of the notorious Venezuelan gang Tren de Aragua (TdA) under the Aliens Enemies Act.

The Trump Administration had designated Tren de Aragua as a foreign terrorist organization and began deportations after a March 15th executive order. The SCOTUS ruling reverses the order of Chief District Judge James Boasberg.
The court lifted a pair of orders by Chief U.S. District Judge James Boasberg that had barred the government from removing noncitizens who were designated as members of TdA under Trump’s March 15 executive order.

While the court declined to rule on the challengers’ contention that the Alien Enemies Act does not apply to them, it did state that the case must be heard in Texas, where the challengers are being held.
By a vote of 5-4, the justices declined to address the challengers’ contention that they are not covered by the AEA. Their lawsuit must be brought in Texas, where they are being held, , the majority wrote, rather than in D.C.

The 5-4 ruling is a big (Yuge, if you will) win for the Trump Administration. Justices Sotomayor, Kagan, Barrett, and Jackson dissented.
