Senator Amy Klobuchar (D-MN) found herself in a heated exchange with Senator Ted Cruz (R-TX) during a Wednesday hearing, where they debated the issue of universal injunctions.
The confrontation occurred during a session titled “Rule by District Judges II: Exploring Legislative Solutions to the Bipartisan Problem,” which aimed to address the rising concern over the power of district judges in issuing nationwide injunctions.

At the heart of the debate was the Trump administration’s record on universal injunctions, with Cruz pointing out that President Trump had received two-thirds of all such injunctions issued over the past 25 years.

As of the hearing, the Trump administration had already been hit with more than 15 injunctions, despite the fact that the president had not yet reached his 100th day in office. In contrast, former President Biden had received only 14 nationwide injunctions during his entire presidency.
Cruz argued that nationwide injunctions, particularly those issued by district judges, represented an “abuse of power” and called for reforms.
“Nationwide injunctions are an abuse of power.”
Klobuchar responded by defending the use of such injunctions, suggesting they were a necessary tool to protect the Constitution in light of what she described as violations by the Trump administration.
“Okay, that was a lot. Let me start with the key things. No. 1: we love the democracy. The only reason there’s all of these injunctions, Sen. Cruz, is because he’s violating the Constitution. Why would Trump appoint judges who — ”

Before Klobuchar could finish, Cruz interjected, asking, “Why don’t you file them in red districts?” This interruption prompted a swift response from Klobuchar, who attempted to continue her argument.
Senator Ashley Moody (R-FL), who was moderating the hearing, stepped in to stop Cruz’s interruptions and allow Klobuchar to continue speaking.
“Why don’t you file them in red districts? Why are the Democratic attorneys general seeking out left-wing — ” Cruz continued before being interrupted again by Moody. ‘

Cruz responded:
“Sen. Moody, we have debates on this committee. They occur regularly.”
Moody, seeking to restore order to the discussion, called a point of order to give Klobuchar the opportunity to finish her comments uninterrupted. Klobuchar, who appeared amused by the exchange, half-laughed and said:
“I will take more than my time since he’s taking more than his time to yell at me.”
The debate over nationwide injunctions has been a contentious issue for years, with critics arguing that they allow a small group of judges to make sweeping rulings that affect the entire country.
In the case of the Trump administration, the use of such injunctions has been particularly prominent, drawing criticism from Republicans, including Cruz, who believe they undermine the authority of the executive branch.

The issue has also been heightened by recent legal actions, such as the ruling by Judge James Boasberg of the U.S. District Court for the District of Columbia.
Nearly two weeks prior to the hearing, Boasberg issued a ruling prohibiting deportation flights, which had a direct impact on the Trump administration’s deportation efforts.
Although the administration proceeded with some deportations, as the planes were already airborne when the ruling was issued, deportation flights have been paused since Boasberg’s decision.
In response to the increasing number of nationwide injunctions, Senator Chuck Grassley (R-IA) introduced legislation earlier this week aimed at ending their use.
The proposed bill seeks to limit the scope of judicial authority and ensure that decisions by district judges do not have nationwide implications.
The debate over universal injunctions is expected to continue, with both sides standing firm on their positions.
Klobuchar’s defense of the use of nationwide injunctions reflects her broader concern with protecting constitutional rights, while Cruz and other Republicans see them as an overreach by the judiciary.
As the issue remains unresolved, lawmakers will likely continue to seek legislative solutions to curb what they see as judicial overreach.
