‘All Of These Crazy Left Judges Are On Notice’: Stephen Miller Says Trump Admin’s SCOTUS Win Sends Clear Message

White House Deputy Chief of Staff Stephen Miller said Monday on Fox News that the U.S. Supreme Court’s decision to allow deportations under the Alien Enemies Act of 1798 signals a “notice” to all of the “crazy left judges.”

The U.S. Supreme Court announced Monday evening that the Trump administration would be allowed to deport migrants linked to the Venezuelan gang Tren de Aragua (TdA) to El Salvador, after U.S. District Judge James E. Boasberg attempted to halt the wartime act. While discussing the decision on “Hannity,” Sean Hannity, the host, told Miller he believed a “big win” for the administration was the court stating the case should have never gone to a D.C. district, as the deportations were conducted out of Texas, adding that Democrats “run to judicial activists” as a strategy to block Trump’s plan.

“Without question,” Miller said. “So, you talk about it many times, Sean, judge shopping, forum shopping. The radical left lawyers like the ACLU will search for the most lunatic left judges in the whole country to try to shut down the president’s action even if there are no plaintiffs where that judge is operating. In this case, we had illegal aliens who were part of a designated foreign terrorist organization who have been declared alien enemies in Texas, and they were suing us in D.C.”

“This judge should have mooted out the case the second it was filed. Instead, the Supreme Court mooted it out for him. What it means is that now all of these crazy left judges are on notice that President Trump is fighting back against lawfare,” Miller added. “He’s fighting back against judge shopping and forum shopping, and we’re going to protect the powers of the president, and we’re going to protect the people of this country.”

A court battle over President Donald Trump’s decision to invoke the wartime act against TdA members on March 15 broke out between the Department of Justice (DOJ) and U.S. District Judge James E. Boasberg. While Boasberg attempted to halt the deportations the same day as Trump’s announcement, three flights had already left Texas carrying over 200 alleged gang members. With neither the DOJ nor Boasberg dropping the case, it was pushed to the U.S. Court of Appeals for the D.C. Circuit before a three-judge panel on March 26. However, just days after hearing the case, the panel upheld Boasberg’s temporary halt, prompting the DOJ to bring the case before SCOTUS.

“You and I, Sean, have spent many hours with victims who have been murdered by the illegal aliens let into this country by Democrats,” Miller said. “President Trump has hugged them. He’s held their hands. He’s looked into their eyes. He has promised them that their loved ones will not have died in vain. He is fulfilling that oath and that obligation, and with this ruling he will be empowered to keep America safe.”

The court’s order, in a 5-4 ruling, states that those detained under the Aliens Act “must receive notice after the date of this order that they are subject to removal under the Act,” noting the notice must be given “within a reasonable time and in such a manner.”

In addition to the Monday evening ruling, Chief Justice John Roberts temporarily halted an order from U.S. District Judge Paula Xinis to bring back alleged MS-13 gang member Kilmar Abrego Garcia, who was deported to El Salvador in March.
